In consideration of being allowed to participate in any activities organized or sponsored by the D.I.V.E.R. Foundation (the “Foundation”), I, the undersigned participant, hereby acknowledge and agree to the following terms:
- Assumption of Risks:
- I am aware that participating in activities organized or sponsored by the Foundation may involve certain inherent risks, including, but not limited to, risks associated with diving, snorkeling, boating, and outdoor recreational activities. I voluntarily assume all risks associated with my participation in these activities, including the risks of personal injury, property damage, or loss.
- Release and Waiver:
- To the fullest extent permitted by law, I hereby release, waive, discharge, and covenant not to sue the D.I.V.E.R. Foundation, its directors, officers, employees, volunteers, representatives, agents, and sponsors (collectively referred to as the “Released Parties”) from any and all claims, liabilities, demands, actions, or causes of action, whether at law or in equity, that may arise out of or be in any way connected with my participation in the activities organized or sponsored by the Foundation, including but not limited to claims for personal injury, property damage, or loss. This release and waiver apply to any claims arising from the negligence, actions, or omissions of the Released Parties, whether such negligence is active or passive.
- Indemnification:
- I agree to indemnify, defend, and hold harmless the D.I.V.E.R. Foundation and its sponsors from any and all claims, liabilities, damages, losses, costs, or expenses (including attorney’s fees) incurred as a result of my participation in the activities organized or sponsored by the Foundation or any claims brought by third parties arising from my actions or omissions during these activities.
- Governing Law and Jurisdiction:
- This Liability Waiver and Release Form shall be governed by and construed in accordance with the laws of [Applicable Jurisdiction]. Any legal action or proceeding arising out of or related to this form shall be brought in the courts of [Applicable Jurisdiction].
- Severability:
- If any provision of this Liability Waiver and Release Form is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
I HAVE READ THIS LIABILITY WAIVER AND RELEASE FORM CAREFULLY AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT I AM RELEASING CERTAIN LEGAL RIGHTS I MAY HAVE OTHERWISE. I VOLUNTARILY SIGN THIS FORM WITH THE INTENTION OF BEING LEGALLY BOUND HEREBY.
